Section 1: Agreement to Rent

Shamrock Medical, LLC agrees to rent to the customer and the customer agrees to rent medical equipment from Shamrock Medical, LLC AS described in the paperwork.   Rental will commence on delivery/pick up of equipment and end when equipment is received or picked up.   Customer agrees to use the equipment as directed by their physician and Shamrock Medical, LLC.

 

Section 2: Equipment Use

Customer will handle equipment with care and operate the equipment only according to instructions given by the Shamrock Medical, LLC staff. Customer will not use equipment in any illegal manner, for any illegal purpose or in a manner that violates any law, ordinance or regulation. Customer will notify Shamrock Medical, LLC of any changes to the equipments condition.   Customer is responsible to obtain any license, permit or permission that may be necessary in order to operate equipment.   Customer will also advise the company facilitating their travel of the equipment and its use in advance of travel. This includes airlines, bus lines, train lines etc.

 

Section 3: Terms

The rental time shall begin the date the equipment is delivered or picked up and conclude on the date the equipment is received at Shamrock Medical, LLC Medical.   Additional days will be charged at the standard rental rate and continue until equipment is returned.

 

Section 4: Payment

Customer agrees to pay all rental charges in advance using a credit card and any time after the agreed upon rental period will be charged to the card according to the standard rental rates. Customer will be bound by the terms of this agreement until Shamrock Medical, LLC receives the equipment back in good working condition.   Any equipment not received back being lost, stolen or broken beyond repair will assess a charge of the published retail amount for the replacement of the equipment.  Shamrock Medical, LLC  strongly encourages all renters to insure the equipment before traveling.   This will offset any charges incurred because of loss or theft.   Customers are fully responsible for equipment while equipment is in their possession. If equipment needs repairs after use repair costs will be charged to the customer.   All taxes, governmental fees, airline fees, licenses etc required will be paid directly by the customer.

 

Section 5: Ownership

Equipment shall remain the property of Shamrock Medical, LLC  unless title is transferred to customer by a separate attached sale agreement. Customer will protect Shamrock Medical, LLC ownership rights from customer’s creditors or other claims against customer.

 

Section 6: Warranty

Shamrock Medical, LLC inspects each piece of equipment before rental to ensure proper operation. Shamrock Medical, LLC Medical warrants that each piece of medical equipment will be suitable for normal use and operation at the time of delivery. SHAMROCK MEDICAL, LLC MEDICAL MAKES NO OTHER REPRESENTATION OR WARRANTY OF ANY KIND.

 

Section 7: Maintenance

Shamrock Medical, LLC or its authorized agents will be the exclusive source to maintain the equipment. Shamrock Medical, LLC inspects, cleans and maintains each piece of equipment in-between each rental customer. Customer will deliver equipment to Shamrock Medical, LLC for all needed maintenance. Customer will bear cost of shipping and repairing any equipment damaged because of misuse, improper power sources etc.  Shamrock Medical, LLC will bear costs for regular maintenance or manufacturer defaults.  A replacement unit may be shipped out to the customer if the equipment fails due to manufacturing defects.  If a replacement unit is shipped out because of improper use, damage, accident, and improper power source etc. all shipping and repair cost will be borne by the customer. Customer agrees not to open the equipment electronics or enclosed housing, alter or repair or permit the alteration or repair of the equipment.

 

Section 8: Limitation of Liability

In no event will Shamrock Medical, LLC be held liable to the customer for any incident, indirect or consequential damages however caused. Customer accepts all liability for using equipment and ensures by signing this agreement.

 

Section 10: Assignment

The customer shall not reassign this agreement to anyone without the written authorization of Shamrock Medical,LLC.   Customer also agrees to only allow the person for which the equipment is prescribed to use the equipment.

 

Section 11: General

Early Returns - The customer will not be granted credit for early returns. No reimbursements will be given for unused time.

Excusable delays – Shamrock Medical will not be liable for delays due to delivery or acts beyond our control.   In the event of an unforeseen delay the dates of this agreement will be postponed in accordance to the delay.   Shamrock Medical will not be held liable for any damage caused as a result of any delay.

Section 12: Billing Terms

Shamrock Medical will charge your credit card for the expected rental time to confirm your reservation. Shamrock Medical will bill your credit card again for any applicable delivery charges.
